These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this Website.

"Conditions" means these terms and conditions; "Product" means a product displayed for sale on the Website; "Product Description" means that part of the Website where certain terms and conditions in respect of the individual Product are provided;  "Users" means the users of the Website collectively; "Personal Information" means the details provided by you on registration; "We/us" means DS Medical; "Website" means the website located at www.dsmedical.co.uk or any subsequent URL which belong to DS Medical that is engaged in bringing you to our Website; "Cookies" means small text files which our Website places on your computer's hard drive to store information about your shopping session and to identify your computer; "Mainland UK" means England and Wales, "You" means a user of this Website.

You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

You warrant that:

You will notify us immediately of any changes to the Personal Information by contacting us by e-mail, or calling us on 0845 2307630 between 9.00am-5.00pm.

You agree to fully indemnify, defend and hold DS Medical, our directors, employees, agents and suppliers, safe immediately from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

We reserve the right to:
modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. • Phone Orders - You may place your order by Phone on 0845 2307630 or 0845 2307631 9.00am until 5.30pm Monday to Friday. Please note that we are closed weekends and Bank Holidays.
• Fax Orders ­ You may order by fax by faxing your order to 01329 829276
• Online Orders - You may place your order online via our website www.dsmedical.co.uk or  www.999supplier.co.uk
• Post Orders ­ You may place your order by post by sending your completed order to DS Medical, 6 Fareham Enterprise Centre, Hackett Way, Fareham, Hants PO14 1TH
• In Person ­ Our Trade Counter facility is open Monday to Friday 9.00am until 5:00pm. Please note we are closed on Bank Holidays and Weekends. The Trade Counter is open to the General Public, we will require proof of identity for certain restricted products

Payments
 We accept the following methods of payment.

• Credit or Debit Card - We accept all major credit and debit cards. Mastercard, Visa, Solo, Maestro and Visa Electron.
• Cheque ­ Made Payable to DS Medical, cheque with order basis. Please note that all cheques require 7 working days to clear before your order is dispatched. Postal Order ­ Made Payable to DS Medical.
• Cash ­ Only taken at the Trade Counter.
• Accounts/Purchase Orders ­ Purchase Orders are accepted by post or fax or email and must quote an official purchase order number.
• BACS/Wire Transfer ­ Account and International Customers can pay directly into our account using the following banking details.
• Name of Bank ­ Barclays Bank, 67-69 West Street Fareham, Hants PO16 0EW.  Account Name: DS Medical, Sort Code 20-30-89, Account 70305812.

Pricing
DS Medical reserve the right to change pricing without notification, DS Medical will endeavour to ensure our suppliers minimise impact of change.
When you place an order to purchase items from DS Medical this is an offer by you to us to purchase those items. We will confirm receipt of your order by sending you an email summarizing the details of your order ("Order Confirmation E-mail"). We accept your order only when we send an e-mail confirming that we have despatched the items in your order ("Despatch Confirmation E-mail"). The contract between us is formed at the point we send the Despatch Confirmation E-mail in respect of those items mentioned in the Despatch Confirmation E-mail.

Product
Product may vary from those illustrated, unless stated all product is sold unkitted.

Sale of Restricted Items
Certain Products are restricted for sale whether by law (e.g. Sale of Knives to under 18 year olds) or protection of Professional Body status. DS Medical reserve the right to challenge those orders and ensure compliance before a sale is completed. DS Medical will contact the customer raising the order to obtain the necessary information to proceed with the sale.
DS Medical reserve the right to refuse the sale if we have reasonable cause to believe ineligibility to purchase goods, or if we believe the supply of Goods may infringe UK law.

Intellectual property and right to use
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

These Terms and Condition and any Contract shall be governed by & construed according to the law of England and the Customer submits to the jurisdiction of the English courts. These Terms and Conditions will prevail over any conditions that shall be issued by the customer. Customers should not rely on any representations made by staff of the Company as they do not form part of the Contract or collateral contract
